The last legs of a Randburg property sale result in the successful property transfer from a Seller to a Buyer. This involved a process where the custodian of the process is the Seller’s appointed attorneys. The seller always gets to choose who they want to do their property transfer.
Seller Appointed Attorneys, Bond Finance and Special Conditions
I can say that the Seller’s appointed attorneys will be waiting for the Acceptance in Principle and then the Final Grant from the Bank where the buyer’s mortgage will be held. This is a key milestone and as estate agents, Nicole and I push really hard at every step to ensure that the property transfer has no delays that can be avoided. We push both the buyers and the sellers. Sellers will need to get all their Compliance Certificates sorted asap. The attorneys will also push to confirm that all the special conditions listed on the Offer to Purchase have been met. Further progress can only be made to a point at which these conditions are met.
Buyer costs, FICA, SARS & Other Docs To Support the Transfer Process
As a buyer when you buy a property you have costs that are referred to as demand costs. These costs include transfer and conveyancing costs. They are demand costs because when the Sellers appointed attorneys call for the costs they must be paid, and only paid to an Attorneys Bank Account. These costs are discussed upfront and often buyers have saved up for these costs. If you would like to have a look at the transfer and conveyancing costs from Louise Tonkin Incorporated, click here. All attorneys have different rates but these rates are regulated. And we only recommend attorneys we can trust to do get the job done right every time with no drama. The compliance certificates that are required will be called for by the attorneys.
Transfer Documents To Support A Randburg Property Sale
The Sellers appointed attorneys will draw up transfer documents which the buyers and the sellers will need to sign. A wet signature is required to conclude this milestone. This is also the opportunity that an Attorney will take to verify you as a buyer or a seller. This is an important legal step. It’s a good idea if you do need to submit approved plans from the Council to bring them with you together with all the other info the Attorney will need to verify you according to strict guidelines. If you are struggling with time to get to the Council let me know and I can recommend a ‘runner‘ to help you – but there is a small fee.
Clearance Certificates For A Randburg Property Sale
I always outline this step of the process as what needs to be done with the municipalities to clear the amount on a property that is sold in terms of what is displayed in City of Johannesburg as we know it. This ensures the seller leaves with a zero balance when they vacate and a buyer moves in on a zero balance when they move in. The attorney orchestrates the timing of this process and ensures that the clearance certificates are applied for and received timeously.
From Lodge to Prep then Registration
Once all the above is in order and has been double-checked by the verifying system and process within the attorney’s office and structure, the documents are all submitted to the Deeds Office for verification. The three steps known as Prep, Lodge then Register are key milestones in the transfer process. This process could take between 5 – 17 days and those are working days. Once registration takes place the proceeds are paid to the attorney for disbursement.
